Woman gets 6 years for homicide
by vehicle
Judge suspends all but 1 year

GRANTS Judge Camille Martinez-Olguin, of the
13th Judicial District Court here ruled on several cases in her
jurisdiction and those cases were filed in district court clerk's
office between Nov. 5-27.
The cases included such sentencing and judgments as:
Homicide by vehicle, aggravated driving while under the influence,
fraud, leaving the scene of an accident, violating probation, escaping
from a police officer, escape from jail and possession of a controlled
substance.
Some of those sentenced received prison time, some
received suspended sentences and some received probation, as set
forth in New Mexico statutes.
- Aimi Martinez, as part of a plea agreement, was
sentenced to six years and 90 days,with all but 364 being suspended
after pleading guilty to homicide by vehicle and aggravated driving
while under the influence on Oct. 2, 2006. Martinez will also
be placed on probation for five years following time served and
will complete an intensive treatment program, for drug and alcohol
abuse for 18 months as well as complete a DWI school. An ignition
interlock device will be placed on Martinez's vehicle and complete
24 hours of community service.
- Brenda Rivera, as part of a plea agreement, had
a conditional discharge of a single charge of contributing
to the delinquency of a minor after pleading guilty. Rivera is
placed on supervised probation for 18 months and any further proceedings
in the case be deferred for one year from Nov. 15, 2007.
- Jimmy White as part of a plea agreement, was found
guilty of fraud and sentenced to 364 days in the Cibola County
detention Center and $1,00 fine. he sentence is suspended on condition
that White be placed on supervised probation for 364 days and
enter and complete a long-term residential drug treatment rehabilitation
program. White is also required to reimburse the victim $400 and
write a letter of apology.
- Peter Guitierrez, as part of a plea agreement,
pleaded guilty to child abuse; DWI, second offense; and leaving
the scene of an accident. He was sentenced to two days shot of
five years, on the charges as above, which will all run coin current
to each other, being three years the maximum sentence and all
but 37 days are suspended. Guitierrez is placed on supervised
probation for three years, less 37 days, credit for time served.
He is ordered to install an ignition interlock device in his vehicle,
shall not operate a motor vehicle and enter and complete a drug
and alcohol assessment. He is court ordered to zero tolerance
by the Adult Probation and Parole Office. He will also complete
a community corrections program and 48 hours of community service.
- Anthony Tapp, as part of a plea agreement, pleaded
guilty to violating probation and was reinstated on probation
until 2012 and is on zero tolerance with the Adult Probation and
Parole Office. He is given seven days credit for time served.
- Miguel Chavez, as part of a plea agreement, pleaded
guilty to violating probation and had supervised probation reinstated
until 2012. He is ordered by the court to enter and successfully
complete a rehabilitation program as well as a community corrections
program. He is ordered to remain in Cibola County detention Center
until accepted b y the rehabilitation center.
- Sam Eylicio, as part of a plea agreement, pleaded
guilty to violating probation and was sentenced to having probation
reinstated. He is ordered by the court to remain in custody in
the Cibola County Detention Center until his probation is accepted
by the Bernalillo County Adult Probation and Parole Office.
- Paul Valdez, as part of a plea agreement, pleaded
guilty to: Escape from a police officer; escape from jail; aggravated
burglary; assault, with intent to commit a violent felony; and
attempted battery on a police officer.
- Valdez received three sentences of 18 months, one
each of nine years, and three years. Said sentences shall run
consecutively for a total of 12 years and a sentence of 364 days
will run concurrently, all in the New Mexico Department of Corrections.
Following time served Valdez will be placed on two years of parole
and is to receive credit for 633 days time served.
- Mandy Thorne-Freeman, as part of a plea agreement,
pleaded guilty to violating probation with underlying charges
of possession of a controlled substance and five counts of forgery.
She as sentenced to 18 months in the Department of Corrections
for the possession charge, three years for each count count of
forgery and shall run consecutively. All of the defendant's sentence
is suspended except for four years and Thorne-Freeman shall receive
credit for 648 days of pre-sentence confinement, Thorne-Freeman
is ordered to be placed on parole for five years following time
served. The court strongly recommended that she be entered into
and successfully complete treatment for trauma symptoms, drug
and alcohol abuse and personality symptoms.
