Judge suspends some sentences for DWI, drugs

GRANTS — Several individuals were sentenced by Judge Camille Martinez-Olguin, 13th Judicial District Court, between Nov. 30-Dec. 13, including some who faced drug trafficking and drug possession.

  • Ivan Garcia, 23, as part of a plea agreement, pleaded guilty to violation of parole, with the charges of two counts of trafficking a controlled substance by distribution, distribution of a controlled substance and resisting an officer. Garcia was sentenced to one day short of 22 years in the New Mexico Department of Corrections, of which all but eight years are suspended. Once released, Garcia is ordered to be placed on supervised probation for five years and parole for two years, to run concurrent to each other. Most of the suspended sentence is due to credit for time already served. The court recommends that Garcia completes any programs recommended by a diagnostic evaluation.
  • Rebecca Chavez, 33, as part of a plea agreement, pleaded guilty to possession of a controlled substance and DWI. Chavez is sentenced to one day short of 21 months in DOC, with all of the sentence, except for time served, to be suspended. Chavez is placed on supervised probation for 18 months. An ignition interlock device will be placed on any vehicles Chavez has access to and she is ordered to undergo a drug and alcohol assessment and follow the recommendations of the assessment.
  • Lorenzo Garcia, 35, as part of a plea agreement, pleaded guilty to possession of a controlled substance. He is sentenced to 18 months in DOC. The sentence is suspended, except for 33 days, for time served, on condition he be placed on supervised probation for 18 months. Garcia is ordered to enroll in and complete any program recommended by the Adult Probation and Parole Office and must obtain her GED.
  • Gwendolyn Billy, 43, as part of a plea agreement, pleaded guilty to DWI, third offense. Billy is sentenced to 364 days in the Cibola County Detention Center with the sentence being suspended and she is placed on supervised probation for the same amount of time. Billy is ordered to enter and successfully complete an inpatient, residential substance abuse rehabilitation program which is a minimum of 28 days. She is also ordered to install an ignition interlock device in any vehicles she may have access to for three years. She is ordered not to possess or consume any liquor, drugs or non-prescription drugs and may not enter any liquor establishments. She is also ordered to not drive any vehicles.
  • Bradford Day, 33, as part of a plea agreement, pleaded guilty to child abuse, intentional, no death or great bodily harm; and DWI, first offense. The court orders that the three-year sentence for child abuse be deferred for three years and the DWI sentence of 364 days will run concurrent to the child abuse sentence. Day is placed on three years supervised probation and is ordered to enter into and successfully complete any program recommended by the Adult Probation and Parole Office. He is required to in stall an ignition interlock device in any vehicles he has access to and not drive any vehicles without the authorization of the Motor Vehicle Department. Day is also ordered to enter and successfully complete a drug and alcohol assessment and follow the recommendations of the assessment. He is to complete 24 hours of community service.
