Grants man charged with assault

GRANTS — A Grants man who was arrested in June and charged in connection with criminal sexual penetration, assault with intent to commit a violent felony against a household member and battery, was arrested again on Aug. 21, this time in connection with false imprisonment and battery on a household member, against the same woman each time.

Brian Olveda, 22, of 1609 Gabaldon, was also indicted Wednesday by the 13th Judicial District grand jury, on the original charges from June.

Grants police officers Sgt. Salvador Corral and Steven Roberts responded to an incident at Motel 6 where a 911 call was made and the dispatcher heard a woman crying in the background, according to Cibola County Magistrate Court records.

Corral had been to the motel earlier in the evening about a previous call involving Olveda and the woman, court records state.

The woman had locked herself in a room at the motel and told officers that Olveda had come to the motel and the couple was doing fine until something set Olveda off and he kicked her in her “backside,” court records state.

He then grabbed her left wrist and pulled her engagement ring off her finger and then forced her to give him a “hug” against her will, according to court records.

He then dialed 911 and left, court records state.

Grants police detective Sgt. James Spidle said Olveda was arrested at the motel, where he was found sitting in his vehicle.

“There was no resistance,” Spidle said, and Olveda did not say why he was sitting at the motel when police arrived.

The grand jury true bill is four counts: Criminal sexual penetration in the third degree, assault with intent to commit a violent felony on a household member, battery against a household member and disorderly conduct.

The incident for which Olveda was indicted by the grand jury occurred on June 2 where Olveda allegedly committed these crimes against the same woman involved in the incident at the motel, supposedly his fiancee.

Olveda faces a preliminary hearing in the motel case on Sept. 4 in Magistrate Court.

As a condition of his release, if he makes bond from the Cibola County Detention Center, where he was placed in custody on a $10,000 bond, he is ordered by the court to complete an anger management course.

On the current charges of false imprisonment and battery against a household member, Olveda faces up to almost two-and-a-half years in state prison and up to a $6,000 fine, or both, if prosecuted and convicted.

On the grand jury indictments, Olveda faces up to eight years in state prison, and up to $ 11,000 in fines, or both.
